Booking Terms & Conditions

The Contract

These booking conditions contain important information. It is essential that you carefully read and understand them. The booking conditions constitute a legally binding contract between you and us for the services provided by us.

By booking with us, you acknowledge that you have read and understood and that you agree to be bound by these booking conditions.

Bookings

All bookings must be paid for in full at the time of booking.

Changes to bookings: Tour times may be changed by you 2 days (48 hours) prior to the date of tour. Please note: A $5.00/person rescheduling fee will be charged for all changes to bookings.

Occasionally, we may have to make changes both before and after the bookings have been confirmed.

Cancellation By You

If you wish to cancel the bookings, notification or cancelation must be made to us via telephone or email.

Cancellation will apply 5% for a refund.
30% of fee if cancelled one day / 24 hour before the tour.
50% cancellation fee will apply if cancelled on the day of the tour booking. However, you can reschedule your tour without any fee.

Making departure time is your responsibility. No refund is made to any person unable to make tour departure times which are linked to ferry public departure times. Call us to meet you on the islands for late arrivals.

Please note that we are not responsible for payment fees of ferry public transport. You can pay with Go-card or cash for a ferry. Inter-island ferry movements are free of charge.

COVID REFUNDS: In the event that there is a new wave of pandemic in QLD and we are advised by our local Council and/or QLD Health to postpone the tour then we will refund your ticket/s in full or transfer your tickets to a future date. If you are too unwell to attend then we will refund or transfer your tickets to a future tour.

Cancellation By Us

We reserve the right to cancel any service prior to departure. Sometimes we must cancel a scheduled tour because of conditions beyond our control ( for example severe weather conditions, bushfires, illness ). Your safety is paramount to us, so if the tour is cancelled, we will notify you on cancellation by telephone or email no later than 7 am of the morning of the scheduled tour. If the tour is cancelled, we will suggest an alternative tour date to suits you or we will promptly refund your payment in full.

We will not be responsible for any consequential losses arising from a cancelation.

Gift Vouchers

Gift vouchers are valid for 12 months and are redeemable for any of the tours.

Gift vouchers are not refundable and, in any portion, redeemable for cash.

Release and Indemnity Form

Before participating at any of our tours, all participants must read and sign our form of Waiver and Release and Indemnity personally or by a guardian if the participant is under the age of 18.

Health and Fitness

It is your responsibility to inform us before the start of the tour of any pre-existing medical condition and / or disability that might reasonably be expected to increase the risk of your required medical attention , or that may affect the normal conduct of a tour and enjoyment of other tour members.

We also reserve the right to cancel your participation in a trip at any time, including after the commencement of the trip, with no right to refund, if your medical condition and / or disability could be reasonably expected to affect the normal conduct of a tour and enjoyment of other tour members.

Code of Conduct

Our tours are non-smoking, and alcohol is prohibited. Participants must show respect to each other and to environment during any tour. We reserve the right to remove any participant whose conduct is deemed to pose a risk or nuisance and we will not refund or cover any costs or expense incurred for their removal.

Age Restrictions

The tour is suitable for children aged 10+.
Children between the ages of 10 and 16 years must be accompanied by an adult (18+ years old).  If no adult is present, the child will not be permitted to attend the tour.

Food and Beverages

You may bring your own food and/or beverages with you on the tour. We will provide you with lunch. We accept no liability for food, drinks and beverages consumed on the tour. When booking a tour with us, you will need to provide us with information on having a vegetarian or a non-vegetarian option to accommodate your food restrictions.

Publicity

You may be asked to agree that we may use images of you taken during the tour without recourse to you and without compensation to you, for publicity and promotion purposes only through whatever medium we choose.

Governing Law

This agreement will be governed by the Law of Queensland.

Website Privacy Policy

This website is owned and operated by Bay Islands Art & Scenic Tours and will be referred as We, Our, and Us in this internet privacy policy. By using this site, you agree to the internet privacy policy outlined on this website page.

We reserve the right, at our discretion to modify or remove portions of this internet privacy policy at any given time.

Personal Information

Personal information about visitors at our side is collected only when knowingly and voluntarily submitted. For example, we may need to collect such information to provide you with further services or to answer or forward any requests / enquiries.

We are not responsible for the privacy practices of websites that are external to our sites.

We will not otherwise disclose your personal information without your consent unless otherwise authorised by law in Australia.

Security

We strive to ensure security, integrity and privacy of personal information submitted to our sites. Unfortunately, no data transmission over the internet can be guaranteed to be totally secure. However, we will try to take all reasonable steps to protect your personal information you may transmit to us. Once we do receive your transmission, we will also make our best efforts to ensure its security on our systems.
